Maternity Leave Rules for Women Government Employees

Women employees are eligible for maternity leaves of 180 days for maximum two surviving children. Maternity leaves can be combined with any other kind of leaves including CCL and can be taken without medical certificate up to one year in continuation. These leaves cannot be debited against leave account and the period of leave will be included in service period for increment and pension. The women employee will be given full pay during the leave period. But one should be careful not to join office back during maternity leave period as this leave can be taken in one spell at a stretch. If woman employee joins back before completing her maternity leave, it automatically gets cancelled.

Women employees are entitled for 45 days of leaves in entire service for in case of miscarriage/ abortion whether induced or otherwise but not for threatened abortion. Application needs to be supported by a certificate given by recognized or registered practitioner. This leave is admissible irrespective of number of surviving children.

After clearing upsc exams,I was awarded DANICS service in 2009.I joined on 15th Feb,2010.We are governed by CCS rules.I proceeded on Maternity leave from the December 2010.I joined back my training in June 2011.My training and probation is for 2 years ending 15thFeb 2012.I would like to know if there are any provisions/way whereby the training period missed is waived off and my probation period also gets completed with my other batch mates.Increasing probation period might affect my seniority and other benefits. Which rules can I refer to in this regard?

my query is:
i have joined my job(on contract) on 18 april 2011, and had d&e due to incomplete abortion (2 month pregnency) due to dog bite, i took leave from 1 may to 5th may for 5 days as i was undergoing treatment. but my leave is not granted and 5 days salary is deducted, so as i didnot gave service for at least 80 days was the reason , or i can ask for it.?

this is is to make the query clear :as after joining on 18 april 2011, and had leave due to d& e from 1/5/2011 to 5/5/2011 , leave should be granted or not, the five day salary deduction is ok, or i should ask for it, or as it was just 16 days after joining , therefore leave is not granted?.pls advice.

The main objective behind

The main objective behind probation period is to give a chance for the worker to prove his talent and the employer a chance to terminate the worker if such person is unable to meet their expectations.
Maternity leave is to secure during maternity it does not involve with probation period.hence your wife should undergo the rest of the probation period as per the rules after she returns from the maternity leave.

She should get maternity

She should get maternity benefit even during probation. Most likely her probation will be increased by the amount of leave taken by her.

Joining Back - Date Calculation

My wife is a school teacher in a govt school in delhi, India. She had applied for maternity leave from June 30th (immediately after summer vacations which were from May 15th to Jun 29th).

As per calcution of 180 days, she had to join back school on Dec 26th.

However, the baby arrived 3 weeks earlier on June 14th (while the summer vacations were still on).

Will the joining date change in this case?

Start of maternity leave is flexible. We've even seen cases where maternity leave applied is after date of delivery. So your wife's joining date should not change. Don't do anything unless somebody in Admin section calls for clarification from her.

Maternity benefit act needs

Maternity benefit act needs at least 80 working days of yours(including Sundays and holidays). Moreover a company policy may be more lenient than the maternity benefit act.

When employees r in child care leave, no ACRs wil be written, What about MACP in sich cases.? and in EOL on medical grounds also service is counted but ACRs are not written. How will they decide MACP in such cases where ACRs are blank? Pl. advise.

my wife was on E.L. of 47 days ( and after that maternity leave from 15th November 2010 to 14 may 2011. from 1st June she is on childcare leave for 4 months. her authority denies to grant her increment on 1st July. i agree that she may get her increment on the day of rejoining but they are not granting her increment on the basis of : she has not completed 6 months duty last year i.e., June 2010 to july2011. kindly mail me the same order/rule copy at the earliest.

I assume she is doing full time job after her recently finished studies. For availing maternity leave she should have worked for minimum 80 days before maternity leave. So I see no problem for maternity leave.
Regarding extension of probation, it is not covered under maternity leave rules. Most likely it'll be extended by number of days leave availed.

during maternity leave , you will not get any increment. When you join back in office, from that day your increment will be effective.for example you were on maternity leave from 1st April to 27 September and your increment date is 1st July but you will get increment from 28 September if you join the office on that day.

As per maternity benefit

As per maternity benefit amendment act 1995, Section 3a (w.e.f. 1-2-1996), No woman shall be entitled to maternity benefit unless she has actually worked in an establishment of the employer from whom she claims maternity benefit, for a period of not less than [eighty days] in the twelve months immediately preceding the date of her expected delivery.
Maternity benefit act applies to women on probation as well.Even your wife is on probation, she can claim maternity benefits (Maternity leave and maternity bonus if no medical expense is paid by the employer)subjected to fulfilling above condition. So just calculate if above condition is fulfilled, ( if it is just a start of pregnancy, I think this condition will be very well fulfilled by the expected date of delivery). Ad-hoc period should count but in your case 80 working days will be easily met from her new permanent job.

As per maternity benefit act , you can start your maternity leave , six weeks before your delivery date. If you are in government sector, you can talk to your reporting officer if you want to start early. I had seen 1-2 cases where with the permission of reporting officer woman employee has started maternity leave 2 months before as well . Only minus point is that you will be left with less leaves after the birth of your child that's why most of the women employees prefer to work upto the date of delivery if their health permits. As per amendment in maternity benefit act in 2008 , one month additional leave can be taken for the illness arising out of pregnancy.

If you are in private sector, you can start your leaves six weeks before your delivery date and check your company's HR policy. Talk to HR manager and discuss your problem.
