Maternity Leave FAQ for Central Government Employees

Q.1 When I can start the maternity leave?
Ans: you can start your maternity leaves six weeks before the expected date of your delivery.

Q.2 Can I work till the day of my delivery so that I can have more time with my baby?
Ans: Yes, You can work up to the day of your delivery and then also you will be entitled for the maternity benefit.

Q.3 Can I ask my office to give me lighter jobs during pregnancy to avoid physical strain?
Ans. You can definitely ask your boss to change your duties if your job involves long standing time, working with obnoxious, hazardous chemicals or any type of work which can be harmful for mother or baby's health and development.

Q.4 What will happen if I join office before completing my maternity leave?
Ans. If you join the office before the completion of your maternity leave period, your maternity benefits automatically gets cancelled. So if you need to do some office job during maternity leave period, do it as obligatory rather than formally joining the office. Remember, office can not compel you to join during maternity leave.

Q.5 Can I extend leaves for the care of the child, after the maternity leaves are over?
Ans. As per CCS rules for government employees, maternity leaves can be combined with any kind of leaves (including commuted leave up to 60 days and leave not due) and extendable up to one year in continuation without medical certificate. Remember the leaves to be taken up in continuation, if you join office, then this rule does not apply. For private sector companies, the policy differs from company to company and one need to check their company's HR policy for details.

Q.6 Can Casual Leaves be combined with Maternity leaves?
Ans. No , Casual Leaves can not be combined with maternity leave.

Q.7 Now, the Government has given one more leave to women employees i.e. Child Care Leave. Can it be combined with Maternity Leave?
Ans. Yes, It can be combined with Maternity leave. remember, not to join back in the office. As soon as you join back your maternity benefits gets cancelled.

Q.8 Can CL be combined with Maternity Leave?
Ans. No since CL is not considered a leave.

Q.9 I've adopted a new born baby , am I eligible for maternity leave?
Ans. Yes it is clearly allowed now( see high court order here).

Q.10 My child has died after birth, am I allowed Maternity Leave?
Ans. From this High Court order, we can see that Judge has made comments that "convalescing from labor and nursing breaks" are part of maternity leaves that's why it should be allowed in case of adoption of child. So even after death due to reason of need of convalescence, it should be allowed in case after death of child.

Maternity is fully paid leave

Maternity is fully paid leave and you'll get all your increments on time. Sometimes you get all those arrears after joining.

Clarification regarding commencement of maternity Leave

If a employee working in a vacational departemnt having summer vacation from 05.05.11 to 23.06.11 and get her delivery on 06.06.2011. she applied ML from 24.06.2011 (i.e. reopeining of school after vacation). In this case here maternity leave will commence from 07.06.11 or 24.06.11?

It should be applied from the date of delivery. But one can apply for the same even 1 month after delivery date but from the date of delivery.

Sanction of leave necessary for drawing increment

I was on earned leave from 12.04.2010 to 31.07.2010 after that maternity leave from 1st Aug 2010 thereafter in continuation i took commuted leave for 60 days and CCL for 277 days. My leave up to my m.l was sanctioned. commuted leave and ccl are yet to be sanctioned. i have joined on 02.01.2012 to my duties. Am I eligible for increment without sanction of my leave as soon as I joined to duties.

Meternity leave for second pregnency

I am working in a private company from 3 nad half years and took meterninty leave till march '2011 for 3 months.
Now i got my second pregnency and forced to continue as per my doctors advice because of my age factor and health condition.
Kindly let me know my eligibility and expline me the policy nad benifits.
My EOD would be end of August 2012

Can ccl be denied on any grounds on continuation with ML and the office(govt.)can force you to join duty.

When taken in continuation it should not be denied except under emergency which does not happen in govt sector.
Only the thing is that you should take CCL in continuation of ML without formally joining office.

Why sacrifice your own career unless special need is there?
Join office after ML and CCL can be taken till 18 years!
Women will become independent only if you show sincerity to your work.

ccl during high risk pregnancy

I am in my fifth month of pregnancy and suffering from preg. induced hypertension which is not getting controlled even when I am taking anti hypertensives thrice daily.The situation gets worse when I am on work.This is risky for my baby.Can I take ccl for the welfare of my baby.

what is the minimum and maximum duration that CCL can be taken?
In this case, how long will the probation period be extended(ML+CCL taken = 1year).

I am currently on my ccl and planning my next pregnancy. Can i go on my maternity leaves in continuation of my ccl. Another question if i am on Leave without pay and in such a period i apply for maternity leaves can such leaves be considered with pay and in service....can it be regularized.

You can take ML in

You can take ML in continuation of CCL. BUt I think If you are currently on without pay and want to go on ML, one technical point may be raised. that as per MLrules you will get the salary as on the date you are starting ur ML. That's why during that period u does not get any increments so I think you should join before ML for some days.

Maternity leave during probation period - central department

I have joined a central department on 2nd January, 2012. I am on probation upto 6 months as per my offer letter. My expected date of delivery is 9th April, 2012 and i shall be requiring maternity leave. I have been told that during probation one is not entitled to leave of any kind. I am curious to know if i shall get maternity leave and can i claim it.

i am availing ccl for my baby who is sick. my husband is working in usa. Is it allowed to go to a foreign country in your ccl.

maternity leave in case of death of child after delivery

I am a central govt. employee.i went on maternity leave one month before my expected date of delivery. unfortunately my child died after four hours of his delivery.
Thus u see that i have already availed a portion of my maternity leave.Can i avail the rest of the maternity leave peiod as maternity leave? What are the documents i need to submit to my office?
