Maternity Leave allowed for Child thru Adoption or Surrogacy

On 6th Jan, 2015 Kerala High Court Judge Ms. Naidu has ruled in favour of Ms. Geetha, DGM in Kerala Livestock Development Board(Kerala PSU) that she be allowed maternity leave despite that she had opted for baby through surrogacy.

Ms. Geetha's maternity leave was denied which made her move to Kerala High Court. The judge has noted that even though Surrogacy isn't covered in Maternity leave rules it should be allowed as there should not be any discrimination of woman with respect to such rules. The judge also noted that the complainant should not be given convalescence leave which may be part of Maternity Leave.
